Undeniably, upon occurrence of certain conditions, this contract can be\nterminated or, when entered into unlawfully, declared non-existent.<\/p>\n\n\n\n<p>Property relationship between the spouses is\ngoverned by laws and regulation, however, practice has proven that legal\nregulation does not always provide the spouses with clarity regarding their\nproperty relationship, which sometimes causes disputes and discrepancies as\nwell as prolonged and expensive judicial proceedings. In order to avoid such\ndisputes or minimise such as much as possible, it is possible for the spouses\nto agree on property relationship by entering into a written contract.<\/p>\n\n\n\n<p><strong>Regulation of property relationship between the\nspouses by a contract<\/strong><\/p>\n\n\n\n<p>Drafting a marriage contract is an option\navailable the spouses themselves, and such a contract may be drafted not only\nduring marriage, but before marriage as well. The purpose of the marriage\ncontract is to regulate property relationship between the spouses, so, by means\nof such contract, the spouses are avoiding not only possible disputes on\ndistribution of property in the future, but also define, at the same time, the\nthreshold of responsibility, for example that the spouse is not responsible for\nthe obligations of the other spouse, or just the contrary \u2013 completely assumes\nsuch responsibility.<\/p>\n\n\n\n<p>Considering that marriage contracts affect the\ncreditors of the spouses, they are of public nature, i.e. subject to\nregistration in a dedicated register kept and maintained in Latvia by the\nRegister of Enterprises.<\/p>\n\n\n\n<p><strong>Dissolution of marriage or declaring it void<\/strong><\/p>\n\n\n\n<p>Dissolution of marriage in court in Latvia may\nbe either simple and quick process or a complicated and time-consuming one if\nrelated to resolving various disputes between the spouses. However, it is\nadvisable to involve a lawyer even in a seemingly simple process to assist in\ndrafting the required documents so that no disputes arise in the future on\nissues not resolved or understood initially.<\/p>\n\n\n\n<p>In the events where the spouses have completely\nagreed on the dissolution of marriage and the related matters (such as\ndistribution of property, custody and contacting rights), the marriage is\ndissolved by a sworn notary, but even in such a case it is advisable to consult\nwith a lawyer regarding preparation of the required documents and applications.<\/p>\n\n\n\n<p>In the events where the spouses are unable to\nagree, the process of dissolution of marriage is in the jurisdiction of the\ncourt.
